The donkey has for MANY years been the mascot of the democratic party here in the USA. Am I the only one who picked up on this and feels that it is a violation of the no political avater clause?

A donkey, elephant, dog, eagle and wide variety of animals have been used historically by many political parties.
That does not mean that pictures of these animals are political in nature and thus banned.
Sometimes a donkey is just a donkey.
