Good advice, except that sometimes local jurisdictions have different laws. Knowing state and local laws is a key part of firearms ownership.


You're right, I always call the local guys first. And the dude contacted the local guys and the local cop said he doesn't know the laws. It's just my bad experiences coming out. Getting legal gun advice from the local guys is like trying to herd cats.

+1 on local police not knowing gun laws.

I live in the OP's county. When I picked up my handgun permits last year they told me I don not need a permit to buy from a private seller. That is bullshit in NC. State law explicitly states that you do need a purchase permit for private sales.

Is it possible to buy a pistol in a neighboring state? I don't know how your state's registration scheme works. Might be worth a shot.

No. Interstate commerce of handguns is prohibited by federal law. You have to do a handgun transfer via an in-state FFL (Federal Firearms Licensee, or gun dealer)

Thats why I can never catch the good sales at Academy sports... 20 min across in S.C, and I can't by a handgun at awesome prices, and not one Academy anywhere in N.C. :x

If you want to get legal advice, talk to a lawyer.

If some guy on the internet gives you bad legal advice, he will probably never even know and will keep giving out that advice, while you are serving time.

If some local or state cop gives you bad legal advice, they might show up at your sentencing hearing, with a heart felt "I'm sorry." for all the good it will do you.

If a lawyer gives you bad legal advice you have a malpractice claim against him and his insurance. You can be damn sure that they will make sure you have top shelf representation through any and all criminal proceedings, and appeals.

Lawyers are cheap for this kind of thing, I used to do it for about $50, or 10% of your gun sales price. Less than you should pay for your holster, less than you should pay for initial supply of carry ammo.

not as sexy a way to spend your cash . . .but way smarter.

most states support the purchasing of a handgun at the age of 18, however due to the states requiring you be the age of 21 the ffl uses a blanbket standard for background checks. whether or not it is leagal in your state I recommend you try and look it up, or you could just call the local police department (i'm serious) non emergency line and they can help you get the info.

from there many gun forums ( I use thehighroad.org) have a section for people selling off firearms, it is up to the person selling whether or not they are willing to sell you the gun as even if it is legal in your state most people don't know just due to many assuming the ffl standard being the only legal age.

If you wanna go the extra mile I recommend getting copies of eachoters photo i.d.s as well as a signed statment showing the transaction and date or get a reciept of sale from your count clerk.

Long time no see!

Well, I've still been pursuing a Glock, and I had a first-hand conversation with my local sheriff today.

Word for word, he told me that purchasing from an FFL is a no-no. Obviously, BUT;

although on the most technical level, purchasing from a private seller could be considered an offense depending on who you ask, nobody, ATF or otherwise, is going to enforce any type of punishment on private sellers or buyers at 18.

Open carry is legal, gifting is legal.

So, not sure how I'd ever hunt down a private seller,

In conclusion, I believe it will be easier for me to look at rifles/shotguns for now.

your surest bets are to either ask your friends if they're selling anything you'd want to buy or ask your family if they'd be willing to get you one as a "gift".
