How to buy a pistol at 18?

So, here in NC you have to be 21 to buy a handgun from an ffl, so gunbroker, pawn, etc is out.

I'm looking for a G23 at around the $400.00 mark give or take.

My problem is, how can you go about finding a private seller with the gun you need aside from word of mouth?
Just wondering if there's any way I can hunt one down and buy a glock. Getting an apartment soon and already have shotguns and rifles out the wazoo, so I'm currently looking for an open carry self defense weapon. Advice? Thanks boys and girls.

Any parents or grandparents nearby? AFAIK, only legal way is to have them buy what you want and give it to you. Face to face from a stranger is still a no-no till you turn 21.

Not sure about NC but PA also allows someone >18 but <21 to purchase face-to-face but the purchase must go through the Sherrif's office. Some sherrifs are more willing to do this than others.

Buying ammo for the pistol may also be an issue since you are under 21.

skyreep: I looked up the laws ( http://www.ncsheriffs.org/images/2007%2 ... %20Pub.pdf ) that I believe are still current, and from what they say WY_Not is spot on. You can't buy a pistol, period. It will have to be gifted to you.

You may have to get some card from the Sheriff to buy ammo, as well.

You may want to call the local sheriff's office and have a chat.

From what I could find through quick searches, it confirms my initial post. You can't buy till 21. Must be gifted. NC follows fed rules and fed says "no buy till 21, gift from parent or grandparent is only exception."

I read the quoted stuff below too fast. It is all relating to people under 18. :oops:

Effective January 1, 1995 North Carolina law found in G.S. 14-315, to prohibit any person from selling, offering for sale, giving away, or in any way transferring to a person under the age of 18 any pistol cartridge, brass knucks, bowie knife, dirk, shurikin, leaded cane, or slingshot. Any person who violates this law is guilty of a Class 1 misdemeanor and, in addition, shall forfeit the proceeds of any sale made in violation of this prohibition.

This statute will further provide that it is a Class H felony for a person to sell, offer for sale, give, or in any way transfer to a person less than 18 years of age any handgun as defined in G.S. 14-269.7. Additionally, an individual guilty of this offense would forfeit the proceeds of any sale made in violation of this section. This law does not apply to the following circumstances:

(1)When the handgun is lent to a minor for temporary use if the minor's possession of the handgun is lawful under G.S. 14-269.7 and G.S. 14-316 and is not otherwise unlawful.

(2)When the handgun is transferred to an adult custodian pursuant to Chapter 33A of the General Statutes, and the minor does not take possession of the handgun except that the adult custodian may allow the minor temporary possession of the handgun in circumstances in which the minor's possession of the handgun is lawful under G.S. 14-269.7 and G.S. 14-316 and is not otherwise unlawful.

(3)When the handgun is a devise or legacy and is distributed to a parent or guardian under G.S. 28A-22-7, and the minor does not take possession of the handgun except that the parent or guardian may allow the minor temporary possession of the handgun in circumstances in which the minor's possession of the handgun is lawful under G.S. 14-269.7 and G.S. 14-316 and is not otherwise unlawful.

Hmm. Roger that guys. So, obviously straw man purchases are illegal, so the only possibility for an 18 year old is that it is gifted from someone with no cash or trade exchange? Because I was under the impression that private purchase was legal. I'm pretty tight with my sheriff, he was my scout leader, let me shoot his glock etc. I suppose I will have to speak with him. I knew that ammo was the same way, but thank you for a heads up.

Holy crap you guys in NC have some convoluted gun laws. Almost as bad as OH. ;-)

Lots more digging... IANAL and all those disclaimers...

At >18 but <21 you can get a handgun by it being gifted. And it looks like you can buy face-to-face. Fed restriction applies to buying from licensed dealer. However, NC requires one of two things...

1. The purchaser or receiver to first obtain a license or permit to receive such a pistol from the sheriff of the county where the purchaser or receiver resides

or

2. The purchaser or receiver must possess a valid North Carolina-issued concealed carry permit. Think you need to be 21 for this option? Done digging. ;)

However, still would be restricted from buying pistol ammo.

In addition, you can OC your pistol once you legally acquire it.

IANAL, so do your own verification of all this.

I have a pistol permit now. It's still unclear as to wether face to face is okay or not. Even the deputy didn't know lol. If I can buy private though, how can I find a private seller with a g23?

Also why a Glock 23? I had one and I hated to shoot it, I thought it was just the round itself was no fun to shoot, then I shot a Sig P226 in .40 and that was very fun to shoot, so I sold the G23 and got a 226 in .40

You have to be 21 to buy a handgun in NC, period. I don't know how you have a handgun permit and you are not 21. You could be gifted a handgun, but that is it.

the same way you find a private seller with anything else you would want (bicycle, car, bbq, golf clubs, etc). Word-of-mouth, online auctions/for sale pages, stuff like that.

And FWIW, I had a G23 and hated it too. I now have a G19, 21, 30, 34, and 36 and love them all. Plus google "40 cal glock recall" and you may change your mind.

He can't buy one from an FFL.

Face-to-face may be another matter. Not sure what the requirements are to get the pistol purchasing permit from the local sheriff are. If he can get one of those, he should be able to buy from an individual.

IIRC think the argument had boiled down to what the difference was between owning, gifting, and purchasing in NC.

I'm not a NC resident, and I barely have an idea of what states other than my own permit above and beyond federal restrictions, so there's not much I can add beyond that clarification.

I've found some nice firearms in the local Thrifty Nickel and if you live near a military post, like Lejeune you can try checking for a site like this website:www.lejeuneyardsales.com/

or even craigslist, I have seen some nice ARs for sale around my AO.

A lot of local police won't know the laws but the state police will. I have moved a lot due to the military and every local PD I have called about gun laws/regs in the area referred me to their state police. Getting legal advice from people you don't know on the internet is definitely the wrong way to go about it. You are pretty young in your life it would really suck to catch a felony and lose your right to own/operate firearms.


So basically call the local PD which seems kinda incompetent in your case but will hopefully refer you to the State Police (the reason I say that is because it is their job to know and enforce laws and they clearly don't know the law). Or just call the experts on legal matters a Lawyer ... You can probably get the legal advice for free it's not that in depth of an issue. Or check with your parents most older people have a lawyer friend or two.

Good advice, except that sometimes local jurisdictions have different laws. Knowing state and local laws is a key part of firearms ownership.
